Terms of Entry

1. The promotion

1.1 These Promotion Terms govern each Exclusive Major Draw, which is a trade promotion. Capitalised terms not defined here have the meaning given in the Platform Terms.

1.2 Participation is deemed acceptance of these Promotion Terms, the completed Draw Schedule, and the Platform Terms. If a person does not agree, they must not enter.

1.3 Nothing in these Promotion Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) (ACL) or any other law that cannot lawfully be excluded.

1.4 The draw is conducted in accordance with the conditions of any applicable trade-promotion permit or authority, including NSW Trade Promotion Authority No. TP/05220. Where a condition of an applicable authority is inconsistent with these Promotion Terms, the authority condition prevails to the extent of the inconsistency.

2. Promoter

2.1 The Promoter is UNICASH Pty Ltd (ABN 90 693 062 538) of 45 St Georges Terrace, Perth WA 6000. Questions may be sent to support@unicash.com.au.

3. Promotion period, entry cap and eligible jurisdictions

3.1 Each Exclusive Major Draw opens and closes at the dates and times set out in its Draw Schedule, in AEST. Entries received before the opening time or after the closing time are not accepted.

3.2 The promotion is open only to eligible residents of New South Wales, Victoria, Queensland, Western Australia, Tasmania, and the Northern Territory. It is not open to residents of South Australia or the Australian Capital Territory, or to any person in a jurisdiction where entry would be unlawful or would require a permit that the Promoter does not hold (a Restricted Jurisdiction).

3.3 Entry cap. The total number of entries is capped at the number stated in the Draw Schedule. Because each person may hold only one entry (clause 4.4), that cap is also the maximum number of entrants.

3.4 The draw closes to new entries on the earliest of: (a) the advertised entries-close time; (b) the entry cap in clause 3.3 being reached; and (c) the draw being cancelled, suspended, or withdrawn under these Promotion Terms or the Platform Terms.

3.5 When the cap is reached. Once the entry cap is reached, the draw is fully subscribed: the draw page shows that no entries remain and no further entry can be purchased. An attempt to purchase an entry after the cap is reached is declined before any payment is taken.

3.6 Waitlist. Where the Platform offers a waitlist after the cap is reached, joining the waitlist is a request to be notified about future draws only. A waitlist place is not an entry, does not reserve an entry, does not confer any chance of winning, and is not a queue for entries released later.

4. Who can enter and how

4.1 Eligibility. Entry is open to Eligible entrants only, as described in the Schedule. An entrant must be an Australian resident aged 18 or older, resident in an eligible State or Territory, hold a UNICASH Account, and must not be an excluded person.

4.2 Membership does not include an entry in this draw. This draw is not part of the Major Draw entry allocation included with a UNICASH Membership. An active Member of any tier receives no entry in this draw by virtue of Membership, receives no loyalty-based or tenure-based accrual toward it, and gains no priority, discount, or additional chance in it. Membership-allocated Major Draw entries continue to apply to standard Major Draws under the Major Draw Terms and Conditions; they do not apply to this draw. Holding a Membership is not required to enter this draw.

4.3 The single entry package is the only way in. The only method of entry is acquiring this draw's single entry package on the draw page, at the price stated in the Draw Schedule. The package confers one (1) entry in this draw and nothing else: it is a single, non-recurring purchase; it is not a Membership; it does not auto-renew; it confers no Membership Benefits, no Points, and no entry in any other draw. Entries in this draw are not made with Points and are not available by scanning a receipt. [Wording of this clause and of clause 4.5 is subject to the legal review noted at the front of this document.]

4.4 One entry per person. A person may hold one (1) entry only in an Exclusive Major Draw, however many Accounts, email addresses, or payment methods that person controls. Where the Promoter identifies a second entry attributable to a person who already holds an entry, the transaction is declined at checkout or, if already completed, the later entry is voided and the amount paid for it refunded.

4.5 How the Promoter identifies the same person. The Promoter matches entrants using the email address on the entrant's Account, applying reasonable normalisation, together with other identifiers reasonably available to it, and may require verification of identity, age, or residency under clause 5 before or after an entry is accepted. The Promoter does not publish the matching method. An entrant who believes an entry was declined in error may contact support@unicash.com.au. [⚖️ The level of detail disclosed here is a question for review — see the front note.]

4.6 Equal chance. Every valid entry has a fair and equal chance of being selected. Because each person holds at most one entry, every entrant has the same chance as every other entrant.

4.7 Entry numbers. Each valid entry is allocated a unique Entry Number for that draw.

4.8 Entries are final; refunds and released places. Once an entry is purchased and confirmed, it may not be withdrawn, transferred, or exchanged, except where required by law (including the ACL) or where the Promoter determines the entry is invalid, fraudulent, duplicate, or in breach of these Promotion Terms or the Platform Terms. Where an entry is refunded or voided before the draw closes, that entry is removed from the entry pool and the place it occupied is released back to the cap. A person whose entry has been refunded or voided may not acquire a further entry in the same draw, unless the Promoter agrees in writing.

4.9 Other open draws. More than one draw may be open at the same time. An entry in this draw applies only to this draw. Membership-allocated entries and Points-based Bonus Draw entries are unaffected by this draw and continue to operate under their own terms.

5. Validation and disqualification

5.1 The Promoter may verify an entrant's eligibility, identity, age, and residency at any time and may withhold a prize until verification is satisfactorily completed.

5.2 The Promoter may disqualify any entry or entrant, and void associated entries or prizes, where it reasonably suspects fraud, tampering, automated entry, or a breach of these Promotion Terms, the Platform Terms, or an authority condition.

5.3 Circumventing the one-entry limit. Creating or using multiple Accounts, email addresses, identities, or payment methods in order to obtain more than one entry in the same draw is a breach of these Promotion Terms. The Promoter may void every entry connected with that conduct, refuse to award a prize, and close the Accounts involved. Amounts paid for entries voided under this clause are refunded, except where the Promoter is prevented from doing so by law.

6. The draw and winner selection

6.1 The winning entry (or entries, where there is more than one prize) is drawn at the date, time, and place, and by the method, set out in the Schedule — on a recorded broadcast, live on the UNICASH Facebook page.

6.2 Method. At the draw, a random number is generated using a publicly visible, independent random number generator shown on the broadcast. The random number corresponds to a Draw Position in the finalised list of valid entries, which maps to the winning Entry Number. The entrant holding the winning Entry Number wins the relevant prize. Where the draw has more than one prize, the process is repeated for each prize in the order stated in the Schedule (First, then Second, then Third). Because each person holds at most one entry, no entrant can win more than one prize.

6.3 Finalised entry pool ("freeze at close"). The list of valid entries is finalised at the moment the draw closes. Any later refund, reversal, or adjustment does not change the finalised pool or the result. The Promoter records the finalised pool details (pool size, Draw Position, and winning Entry Number) at the time of selection.

6.4 Verifiability. The Promoter publishes a SHA-256 verification hash derived from the finalised entry pool so the integrity of the pool used for the draw can be independently checked. The Promoter's records of entries, draw conduct, and results are conclusive in the absence of manifest error.

6.5 The draw is conducted in the manner, and at the date, time, and place, required by any applicable authority (including NSW Authority No. TP/05220).

7. Notification of the winner

7.1 The winner is notified by telephone and email, using the details on the winner's Account, on or promptly after the draw date, and in any event within any period required by an applicable authority.

7.2 The winner may be required to respond, verify identity, and confirm eligibility within the period stated at the time of notification before the prize is awarded.

8. Publication of the winner and publicity

8.1 As required to conduct the trade promotion and satisfy authority conditions, the Promoter publishes the winner's first name, last initial and State, the prize, the Draw identifier, and the draw date on the UNICASH website and the UNICASH Facebook page, together with a SHA-256 verification hash of the finalised entry pool, within the time required by the applicable authority.

8.2 By entering, each entrant consents to that publication for transparency and authority-compliance purposes. The Promoter will obtain the winner's separate written consent before using the winner's full name, image, voice, or likeness for any wider promotional or advertising purpose. The Promoter does not publish a winner's full surname, email address, telephone number, or full address.

8.3 A winner may ask the Promoter to withhold optional publicity by emailing support@unicash.com.au before the draw closes; the Promoter will accommodate that request except to the extent publication is required by an authority condition or other law.

9. Prizes

9.1 The prizes are as described in the Schedule — first, second and third prize, each with its stated value and any condition attaching to it. Prizes are not transferable or exchangeable and, unless expressly stated, are not redeemable for cash.

9.2 Substitution. If a prize becomes unavailable for reasons outside the Promoter's reasonable control, the Promoter may substitute a prize of equal or greater value, subject to applicable law and any authority condition.

9.3 Tax. Winners are responsible for any tax or reporting obligation arising from a prize. The Promoter does not provide tax advice and recommends independent advice.

9.4 Delivery. Prizes are delivered or made available in the manner and within the time described in the Schedule. Delivery to the details on the winner's Account is at the winner's risk.

10. Unclaimed prizes and redraw

10.1 If a winner cannot be contacted, does not respond to reasonable contact attempts, does not complete verification, or is found ineligible, within three (3) months of the draw (and in any event within any period required by an applicable authority), the prize may be forfeited and an unclaimed-prize redraw held on the redraw date and at the place stated in the Schedule, from the remaining valid entries in the finalised pool, using the method in clause 6.

10.2 The Promoter conducts and, where required, notifies and publishes any redraw in accordance with the applicable authority conditions.

11. Payment and refunds

11.1 The entry package is a digital product supplied on purchase. To the extent permitted by law, the amount paid is non-refundable once the entry is allocated, except: where required by the ACL; where the entry is voided under clause 4.4, 5.3, or 13.2; or where the Promoter agrees to a refund in writing. Refunds are otherwise handled under the Refund Policy.

11.2 No payment is taken once the draw is fully subscribed. Once the entry cap is reached, entry purchases are declined before any payment is taken (clause 3.5). If, despite that, a payment is completed at the moment the cap fills and no entry can be allocated to it, no entry is created and the full amount paid is refunded to the original payment method.

11.3 Entries in this draw are not made with Points. Points remain governed by the Platform Terms, have no cash value, and are not legal tender, a financial product, or stored value.

12. Privacy

12.1 The Promoter collects and handles personal information in accordance with the Privacy Policy and the Privacy Act 1988 (Cth). Information collected for this draw is used to conduct the draw, verify eligibility, apply the one-entry-per-person limit in clause 4.4, award and deliver prizes, publish the winner as described in clause 8, satisfy authority conditions, and comply with the law. Records are retained for at least the period required by each applicable authority.

13. Cancellation, suspension, or variation

13.1 Subject to applicable law and any authority condition, the Promoter may suspend, vary, withdraw, or cancel a draw where it is not reasonably able to conduct it as planned — including due to fraud, technical failure, an event outside the Promoter's reasonable control, an error in the prize, pricing, or eligibility, or where the integrity or fairness of the draw is materially compromised.

13.2 Where a draw is cancelled before entries are accepted, amounts paid are refunded in full. Where a draw is cancelled or varied after entries have been accepted, the Promoter will determine an equitable remedy consistent with applicable law and any authority condition, which may include refunding entry package amounts, substituting a prize of equal or greater value, or running a replacement draw.

14. Liability

14.1 Nothing in these Promotion Terms limits any right or remedy an entrant has under the ACL or any other law that cannot lawfully be excluded. To the extent permitted by law, the Promoter's liability in connection with a draw is limited as set out in the Platform Terms, and the Promoter is not liable for late, lost, or misdirected entries, or for any technical failure affecting entry, the draw, or prize delivery, except to the extent caused by the Promoter's own failure to take reasonable care.

15. Permits, authorities and jurisdiction

15.1 This draw is conducted as a trade promotion under the conditions of NSW Trade Promotion Authority No. TP/05220 and any other permit or authority required for an eligible jurisdiction. The applicable authority number(s) are shown in the Schedule, on the draw page, and, where required, in advertising for the draw.

15.2 An entrant is responsible for ensuring that participation is lawful in the entrant's jurisdiction. The Promoter may refuse, cancel, or void any entry or prize that originates from a Restricted Jurisdiction (including South Australia and the Australian Capital Territory) or that breaches applicable law or an authority condition.

16. General

16.1 These Promotion Terms are governed by the laws of Western Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that State and the courts competent to hear appeals from them, subject to the conditions of any authority under which the draw is conducted.

16.2 If any provision is held to be invalid or unenforceable, it is severed and the remaining provisions continue in force.

16.3 These Promotion Terms must be read with the UNICASH Terms and Conditions, the Privacy Policy, and the Refund Policy.
